My
wife does not live with me and not even divorce me!

Due
to my busy schedule, I am coming after many days, it is difficult for me to
write or answer your questions but I am trying my best.
So,
as you see, I have come up with a new topic that one of my readers asked me!
And, I have seen this question get asked frequently. I have tried to answer
this question situationally based on my legal knowledge.
"My wife left me after 11 months of marriage, she sent me a
legal notice. And falsely accused me and my family. I wanted to be together,
but she denied me and deserted me from worldly pleasures. Neither she is living
with me nor divorcing me. What should I do in this situation?"
Unfortunately,
she started taking revenge on him without leaving him. It quite funny na! But
it is absolutely true.
Many cases are pending in family court, which
are 7- to 10-year-old. Where wife does not agree to live with her husband or
divorce him. But the question is, how to deal with this situation!
I have given some basic solution but these solutions depend on the situation, which follows-
1. 1. In case
spouse unheard for more than 7 years-
This
presumption drawn under the sec.108 of the Indian Evidence Act, 1872.In such
case spouse considered dead and other spouse can remarry, time on the ground
that the former marriage has been dissolved due to the civil death of his or
her spouse.
2.when wife
does not agree to live with her husband or divorce by consent-
When
wife is not accepting for mutual divorce, you can initiate the divorce process
by filing divorce petition under the cruelty and desertion (but to prove that
cruelty and desertion, you have to complete 2 years of complete separation) you
can file a petition in the family court of your jurisdiction. It will take
time, but it's better than waiting.
Marriage
is common social practice in our human society and we place it at the top of
our social practices. But making a marriage last is very difficult and often
things go wrong. It doesn't matter who is wrong and who is right! But it's
better to figure out what to do next and how to proceed. But many couples
just stick to their problem and don’t move on!
