Child Custody Before and After Divorce
“Wife: - I think, we have to make a decision now, enough is enough!
Husband: - Sure... Why not! (Angrily)
Wife: - There is no love left in our relationship and now it is suffocating.
Husband: - I also don’t think our relationship will be smooth, it’s better, we went our separate ways! (Husband argued wife irritated)
Wife: - okay then! let's Divorce!”
Ooooohoooo! Such a heartbreaking discussion! Whatever the reason behind this discussion, it always the last conversation before getting a divorce. But when a couple decides to divorce, do they think about their children? Of Course Yes! Why they don’t?
The child is the first priority for their parents but still the issue of suffocation in the marital relationship then couple always do what is right for them. It is obvious that, children have to suffer a lot in such a situation. Parents are just as important to children, because they don’t understand the real problem of their parents.
Life is uncertain, but couples who have to deal with this stage of life and if they have a child, then they really care about the child custody provisions.
So, we are going to discuss the provisions regarding child custody before and after divorce.
* Indian provisions over child custody before and after divorce-
1.Both parents have equal rights over the child even after a legal separation.
2.Division of parental property, and financial support for the child’s education.
3.In some cases, custody of child shall be handed over to the person who foster him /her with love, care and affection.
4.Court also considers the choice of children, who above the 9 years of age. When the child is less than 5 years of age custody is usually given to the mother.
1.Joint custody of child
2.Sole custody of child
3.3rd person custody of child
4.Granted custody to mother in case of girl child
5.If the mother is willing to give up girl child custody, then father may get custody.
Child custody doesn’t mean the other ceases to be the parent and lose all rights over the child.
Child custody is always an emotional and heart touching subject. In the process of parental divorce, I have seen children go through emotional trauma and most of the time they have to go to a psychiatrist. But we have to understand, parents make any decision about their relationship, they need to confront their children and give them a chance to understand the situation. If, your child is too young to understand tell them when they are mature to understand the real situation.
