Housing society is a society of a group of flats. where we live with our family and friends. But Peace is really important when you live in a flat system community.
But, most of the time, the residential peace is disturbed by commercial activities. And this question always comes to mind, are these commercial activities legal or illegal in residential area?

We have always seen these activities in the residential society. If, I am not wrong, you or your friend may be doing one of these home-based business. Mostly, I have always seen women like to run a home-based businesses. But somehow, these occupiers are afraid to be opposed on the ground of legality or illegality.
I want to let you know that all of these businesses are non-commercial and can be done by men and women.
As per law, the services of Advocate or lawyers, doctors, accountant, yoga classes, tuition classes, home day care are approved as non-commercial activities in the housing society.
But the interesting thing is! Home-based parlors, home-based food services and home-based clothing sales services are partially commercial or partially non- commercial. If, only 20% of the services are operated from home, then they will be considered as non- commercial services. If their business runs 100% then, it counts as commercial services. And such service should be registered under the shop & establishment Act.1948

If you intended to carry out commercial activity at the residential property then, you are obliged to obtain a license under the Shop Act.1948
3.How to file a complaint against illegal commercial activities in housing society-
Generally, commercial activities not permitted for security reason, besides being a serious traffic nuisance for resident.
Our legal policies do not allow commercial activities in residential area and therefore provides a way to file a complaint against commercial activity.
Those are as follows-
A. File a complaint to local municipal office
B. File a police complaint for public nuisance of your area
C. File a suit about public nuisance in junior level court in your area of jurisdiction
