Today, I have brought up a new knowledgeable topic. I have observed most of people having a confusion between judicial and non-judicial stamp paper. So, let's get some interesting information about the judicial and non- judicial stamp paper. Well! let’s see interesting historical facts about the Indian stamp duty Act. 


  • History of Indian judicial and non-judicial stamp paper- 

The stamp paper is a Spanish invention and it was introduced in Netherlands in the 1620. It was used widely in France, Great Britain, India, United State and etc. 

In England, it was first adopted by King Charles II. The British Parliament passed the Stamp Act in, March 22,1765 to help pay for British troops. 

When British first time introduced the Stamp law in 1797 under regulation of VI, which was limited to Bengal, Bihar, Orissa and Banaras. Further, it was introduced in Bombay and Madras. 

 

First, Act was related with “stamp” enacted in 1860, and it was replaced by “The Stamp Act, 1862”. In recent years, it was amended many times in years 1869,1879,1899. 

The British introduced the stamp act to increase and protection of the revenue of land. This stamp is used as a court fee under the Court Fee Act 1870. 

 

  • What is the Judicial and Non- Judicial Stamp Paper- 

There is slight difference between judicial and non-judicial stamp paper. The judicial stamp paper bared word “court fee” and non-judicial stamp paper bared word judicial. Let's differentiates in simple ways.

Judicial stamp paper is used for legal and court work. 

Non- judicial stamp paper used for registration of various documents.

Judicial stamp paper used in court like payment of court fee. 

Non-judicial stamp paper used in execution of document.

It is related with administrative justice and used in civil suits, complaints etc. 

It is related to transfer of property, commercials, power of attorney.

Judicial stamp paper is paid under Court fees Act,1870. 

Non-judicial stamp paper is paid under the Indian Stamp Act of 1899.

For sale deed, transfer of immovable property, affidavits, agreements, deeds, wills etc.  

  

  • Interesting Facts of Stamp- 
  1. 1.The idea of rising revenue for the state from the transaction of    state citizens.

  2. 2.Stamp paper printed on security paper that     has additional characteristics coated. 

  1. 3.The market value of the property determines the amount of stamp paper. 

  1. 4.If, the stamp paper is lost then visit nearest police station and  file a FIR. 

  1. 5.You can get stamp paper from authorized stamp vendor. 

  1. 6.The Indian security press deals with the supply of stamp paper for state and central government. 

  1. 7.Government is investing huge amount for printing judicial and non-judicial stamps and commission to stamp vendor’s as to prevent fraud and hassles to people.
